These Terms & Conditions (“Terms”) govern your access to and use of the website operated by 1813 (Tinonee Vineyard Estate) (“we,” “us,” “our”), located at 1273 Milbrodale Road, Broke NSW 2330, including all content, online store, bookings, and Club 1813 membership functions (the “Website”).

By accessing or using the Website, placing an order, making a booking, or joining Club 1813, you agree to be bound by these Terms. If you do not agree, please do not use the Website.

Age Restriction

Our products and services relate to the sale and supply of alcohol. By using this Website, you confirm that you are at least 18 years of age. We reserve the right to request proof of age at any point, including on delivery or collection of an order, and to refuse service to anyone who cannot provide satisfactory proof of age.

It is against the law to sell or supply alcohol to, or obtain alcohol on behalf of, a person under the age of 18 years.

Products and Pricing

  • All prices listed on the Website are in Australian Dollars (AUD) and are inclusive of GST, unless otherwise stated.
  • We make reasonable efforts to ensure product descriptions, vintages, and pricing are accurate, but errors may occur. We reserve the right to correct any errors and to cancel or amend an order affected by a pricing or descriptive error, with notice to you.
  • Product availability is subject to stock on hand. Limited release wines may sell out without notice, consistent with our estate’s production model.
  • We reserve the right to change prices at any time without notice, though changes will not affect orders already confirmed.

Orders and Payment

  • By placing an order, you make an offer to purchase, which we may accept or decline at our discretion (for example, where age verification cannot be confirmed, or stock is unavailable).
  • Payment is processed securely through our third-party payment provider. We do not store full payment card details.
  • A confirmation email will be sent once your order is accepted. This does not guarantee fulfilment if a product subsequently becomes unavailable.
  • We reserve the right to limit order quantities, particularly for limited release wines.

Shipping and Delivery

  • We deliver within Australia [and to specified international destinations] using third-party couriers.
  • Estimated delivery timeframes are provided as a guide only and are not guaranteed.
  • Someone aged 18 or over must be available to receive and sign for alcohol deliveries. Couriers may require proof of age on delivery.
  • Risk in the goods passes to you on delivery. Title passes once payment is received in full.
  • Shipping costs, where applicable, will be displayed at checkout prior to payment.

Returns and Refunds

  • Due to the nature of our products, we do not offer refunds or exchanges for change of mind.
  • Where a product is faulty, damaged in transit, or materially different from its description, please contact us within [7] days of delivery, and we will arrange a replacement, refund, or credit in accordance with the Australian Consumer Law.
  • Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded.

Accommodation, Cellar Door, and Venue Hire Bookings

  • Bookings for accommodation (The Residence, The Cottage), cellar door tastings, and venue hire/events are subject to availability and any specific booking terms, deposit requirements, and cancellation policies provided to you at the time of booking.
  • A deposit or full payment may be required to confirm a booking. Cancellation and refund terms will be set out in your booking confirmation or a separate booking agreement.
  • We reserve the right to refuse entry or service to guests who are intoxicated, behave inappropriately, or cannot provide proof of age.

Prize Draws and Promotions

Any prize draws or promotions conducted via the Website are subject to their own published Terms & Conditions, which take precedence over these Terms in relation to that specific promotion.

Intellectual Property

All content on the Website — including text, images, logos, branding, label artwork, and design — is owned by or licensed to 1813 and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or use any content without our prior written consent, other than for personal, non-commercial use.

User Conduct
